By accessing or using our website, placing an order, creating an account, subscribing to our communications, or using any of our services, you agree to be bound by these Terms & Conditions, together with our Privacy Policy, Returns Policy, Shipping Policy and any other policies linked on our website.

If you do not agree to these Terms, please do not use our website or purchase from us.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that allows us to sell our products to you.

By using our website, you confirm that you are at least the age of majority in your place of residence, or that you have consent from a parent or guardian to use our website.

You must not use our website or products for any unlawful or unauthorised purpose. You must not interfere with the security, operation or integrity of our website, transmit malware, scrape content, impersonate another person, or use our website in a way that breaches applicable laws.

When you place an order with FELLA, you are making an offer to purchase the products in your cart. We may accept or reject your order at our discretion, including where:

1. a product is unavailable;
2. there is an error in the product description, price or availability;
3. we suspect fraud, unauthorised activity or resale activity;
4. payment is not authorised;
5. shipping restrictions apply; or
6. we are otherwise unable to fulfil the order.

An order is not accepted until we send you an order confirmation or dispatch confirmation.

We reserve the right to limit or cancel quantities purchased per person, household, account, payment method, billing address or shipping address.

We make reasonable efforts to ensure that product descriptions, images, sizing information, pricing and availability are accurate. However, errors may occur.

Product colours may appear differently depending on your screen, device settings and lighting. We cannot guarantee that your device will display colours exactly as they appear in real life.

Our product descriptions and sizing guidance are provided to help you choose the right product, but they do not guarantee that a product will fit every body or meet every individual preference.

Prices are displayed in the currency shown on our website at checkout. Prices may change without notice. Unless stated otherwise, prices do not include shipping charges, customs duties, import taxes or other local charges that may apply to international orders.

If a product is listed at an incorrect price due to a typographical, technical or administrative error, we may cancel or refuse the order and refund any amount paid.

Payment must be made at the time of purchase using one of the payment methods available at checkout.

You confirm that you are authorised to use the payment method provided. We may use third-party payment processors to securely process payments. We do not store full credit card details on our own systems.

Your order may be subject to fraud checks or payment verification before dispatch.

Shipping options, costs and estimated delivery times are shown at checkout or in our Shipping Policy. 

Delivery times are estimates only and may be affected by customs processing, carrier delays, public holidays, weather, incorrect shipping information, or other circumstances outside our control.

Risk in the products passes to you once the products are delivered to the shipping address you provided, unless otherwise required by applicable law.

You are responsible for providing accurate shipping information. We are not responsible for orders lost or delayed due to incorrect or incomplete delivery details provided by you.

If you place an order for delivery outside Australia, your order may be subject to customs duties, taxes, import fees or other charges imposed by the destination country.

Unless expressly stated at checkout, these charges are your responsibility. We are not responsible for delays caused by customs or import processing.

You are responsible for ensuring that the products you order can be lawfully imported into your destination country.

Returns, exchanges and refunds are handled in accordance with our Returns Policy.

Nothing in these Terms or our Returns Policy excludes, restricts or modifies any rights you may have under applicable consumer laws, including the Australian Consumer Law.

Under the Australian Consumer Law, products come with consumer guarantees that cannot be excluded. Consumers may be entitled to a repair, replacement, refund or other remedy where goods fail to meet a consumer guarantee. Businesses also cannot simply refuse refunds because of store policy where the law requires a remedy.

For hygiene reasons, swimwear may need to be returned unworn, unused, unwashed, with hygiene liners intact and original tags attached, unless the product is faulty or otherwise required to be accepted under applicable law.

Promotions, discount codes, store credits and gift cards may be subject to additional terms, including expiry dates, minimum spend requirements, product exclusions or limits on combining offers.

Unless otherwise stated:

1. discount codes, store credits and gift cards, expires 3 years from the date of issue.
2. store credits and gift cards are not redeemed in full, the remaining balance will remain valid for 3 years from the date of issue.
3. if the full value of store credits and gift cards are not redeemed within 3 years, any remaining balance will be forfeited.
4. discount codes must be used at checkout and cannot be applied retrospectively;
5. promotions are valid for a limited time only;
6. promotions may be changed or withdrawn at any time;
7. discount codes have no cash value;
8. only one discount code may be used per order; and
9. gift cards and store credits are non-refundable except where required by law.

From time to time, we may offer pre-order, waitlist, limited-edition or made-to-order products.

Estimated dispatch dates for pre-orders are estimates only and may change due to production, shipping or supply-chain delays. If there is a significant delay, we will try to notify you using the contact details provided with your order.

We may cancel and refund a pre-order if we are unable to fulfil it.

You may be able to create an account on our website. You are responsible for keeping your account login details confidential and for all activity under your account.

You agree to provide accurate, complete and current information. We may suspend or terminate your account if we reasonably believe that you have breached these Terms, provided false information, or used your account unlawfully.

If you opt in to receive SMS or mobile messages from FELLA, you agree to receive recurring text messages from us, which may include order updates, cart reminders, product launches, promotions, offers and other marketing messages.

Consent to receive marketing text messages is not a condition of purchase.

Message frequency may vary. Message and data rates may apply. Charges are determined by your mobile carrier.

You can opt out at any time by replying STOP to our messages, or by following any other opt-out instructions provided in the message. For support, contact customercare@fellaswim.com.

We may change, suspend or discontinue our SMS program at any time. We are not responsible for delayed, failed or undelivered messages, or for charges imposed by your mobile carrier.

You confirm that the mobile number you provide is your own and that you are authorised to receive messages at that number. You agree to notify us if your mobile number changes.

If you subscribe to our mailing list or otherwise opt in to marketing, we may send you emails about FELLA products, campaigns, launches, promotions and events.

You can unsubscribe from marketing emails at any time by using the unsubscribe link in our emails or by contacting us.

Even if you unsubscribe from marketing, we may still send you transactional emails, such as order confirmations, shipping updates, customer service responses or legal notices.

If you submit reviews, photos, comments, feedback, ideas, social media content or other materials to us, you confirm that:

1. the content is your own or you have permission to share it;
2. the content does not infringe any third-party rights;
3. the content is not misleading, defamatory, offensive, unlawful or harmful;
4. the content does not contain viruses, malware or harmful code; and
5. you are responsible for the content you submit.

By submitting content to us, tagging us, mentioning us, or authorising us to use your content, you grant FELLA a worldwide, royalty-free, non-exclusive licence to use, reproduce, edit, publish, display, distribute and share that content for marketing, promotional, website, social media, advertising and business purposes, subject to applicable law.

We may monitor, edit, refuse or remove user content at our discretion.

All content on our website, including text, images, graphics, logos, product names, designs, photography, videos, icons, layout, look and feel, and other materials, is owned by or licensed to FELLA and is protected by intellectual property laws.

You may view and use our website for personal, non-commercial shopping purposes only.

To the maximum extent permitted by law, you agree to indemnify FELLA and its directors, officers, employees, contractors, suppliers and service providers against any claims, losses, damages, liabilities, costs or expenses arising from:

We may suspend or terminate your access to our website or services if we reasonably believe that you have breached these Terms or used our website unlawfully or improperly. The clauses that by their nature should survive termination will continue to apply, including clauses relating to intellectual property, payments, disclaimers, limitation of liability, indemnity and governing law.
